Kathmandu: The Supreme Court (SC) has stayed the government’s decision to scrap the Land-related Problems Resolution Commission.
A single bench of Justice Ishwor Prasad Khatiwada issued an interim order on Monday while conducting a preliminary hearing on the writ filed by Chairman of the Commission Devi Prasad Gyawali. Gyawali moved the apex court on Sunday arguing that the scrapping of the commission was unconstitutional.
The petition has demanded that the government’s decision be overturned arguing that the fundamental right to housing has been violated. The Office of the Prime Minister and Council of Ministers, Prime Minister Sher Bahadur Deuba and the Ministry of Land Management, Cooperatives and Poverty Alleviation have been named defendants in the petition.
The government on last Tuesday had decided to scrap the Commission.
The Commission was formed as per the Land related Act (eighth amendment) to implement the state’s directive principles and policies, mentioned the statement. The Commission was formed around one year ago and a district-based committee of the Commission was formed in all the 77 districts.
The main opposition CPN-UML has been demanding an immediate correction to the government’s decision, saying the decision has hit the people’s expectations and rights. Protests have been staged in different parts of the country against the decision.
