Kathmandu: A total of six writ petitions have presented before the Supreme Court (SC) on Friday against President Bidhya Devi Bhandari’s move to call for the formation of a government as per Article 76 (5) of the Constitution.
The writ petitioners have argued the move to be unconstitutional saying that process of forming a new government can’t be initiated without resignation by Prime Minister K P Sharma Oli or completing the process for a vote of confidence.
Chief of the Case Division of the apex court Baburam Dahal said that no decision has been taken on the registration as writ petitions have not been studied yet.
President Bhandari on Thursday had called upon the Members of Parliament (MPs) to submit their claim for the premiership till 5:00 pm today to appoint the Prime Minister as per Article 76 (5) of the Constitution of Nepal.
It was stated that such a move was advanced to pave a way for the formation of an alternate government since it was not appropriate to keep the country in uncertainty since there was no fundamental difference in political context than that of May 10 for getting a vote of confidence for the incumbent government.
